Terms and Conditions

1. Acceptance of Terms

By accessing or using Go Hang Out ("the Service"), operated by Nobler Works LLC ("we," "us," or "our"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Description of Service

Go Hang Out is a social platform that enables users to create and join interest-based groups, organize and attend hangouts, and connect with others in their community. The Service includes both free and premium subscription tiers.

3. Eligibility

You must be at least 18 years old to use the Service. By using Go Hang Out, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

4. Account Registration

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your password and account
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

5. User Content and Conduct

5.1 Your Content

You retain ownership of content you post on Go Hang Out ("User Content"). By posting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your User Content in connection with operating and improving the Service.

5.2 Prohibited Conduct

You agree not to:

  • Post false, misleading, or deceptive content
  • Harass, bully, threaten, or intimidate other users
  • Post content that is illegal, harmful, or violates others' rights
  • Impersonate any person or entity
  • Use the Service for any illegal purpose
  • Attempt to gain unauthorized access to the Service or other accounts
  • Use automated means to access the Service without our permission
  • Interfere with or disrupt the Service or servers
  • Collect or harvest user information without consent
  • Use the Service for commercial solicitation without authorization
  • Post sexually explicit content or content depicting violence
  • Discriminate against others based on protected characteristics

5.3 Content Moderation

We reserve the right, but are not obligated, to monitor, review, and remove User Content at our sole discretion. We may suspend or terminate accounts that violate these Terms.

6. Groups and Hangouts

6.1 Group Creation and Management

Users who create groups ("Group Organizers") are responsible for managing their groups in accordance with these Terms. Group Organizers may establish additional rules for their groups, provided they do not conflict with these Terms.

6.2 Hangout Safety

When attending hangouts organized through the Service, you acknowledge that:

  • You participate at your own risk
  • We do not verify the identity or conduct background checks on users
  • We are not responsible for the conduct of any user at hangouts
  • You should exercise caution and good judgment when meeting others
  • You should meet in public places and inform someone of your plans

7. Subscription and Payments

7.1 Free Tier

The free tier allows users to join up to 3 groups and create 1 hangout per month.

7.2 Premium Subscription

Premium subscriptions are available for $7.00 USD per month and provide unlimited group memberships, unlimited hangout creation, and the ability to create groups.

7.3 Billing

Premium subscriptions are billed monthly in advance. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel. Payments are processed through Stripe.

7.4 Cancellation

You may cancel your premium subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period. No refunds are provided for partial months.

7.5 Price Changes

We may change subscription prices with at least 30 days' notice. Price changes will take effect at the start of your next billing period after the notice.

8. Privacy and Data

8.1 Data Collection

We collect and process personal information as described in our Privacy Policy. By using the Service, you consent to our data practices as outlined in the Privacy Policy.

8.2 Profile Information

You control the visibility of your profile information through privacy settings. Certain information (name, username, avatar) is always visible to other users. You may choose to share additional information such as social links, location, age, and contact details.

8.3 Data Retention

We retain your data as long as your account is active or as needed to provide the Service. You may request deletion of your account and associated data by contacting us.

9. Intellectual Property

9.1 Our Rights

The Service, including its design, features, and content (excluding User Content), is owned by Nobler Works LLC and protected by copyright, trademark, and other intellectual property laws.

9.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes in accordance with these Terms.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOBLER WORKS LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify, defend, and hold harmless Nobler Works LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your User Content, or your violation of these Terms.

13. Termination

We may suspend or terminate your account and access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease.

You may terminate your account at any time by deleting it through account settings or by contacting us. Termination does not entitle you to any refund of subscription fees.

14. Dispute Resolution

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

14.2 Arbitration

Any dispute arising from or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Delaware, and the arbitrator's decision shall be final and binding.

14.3 Class Action Waiver

You agree that any disputes will be resolved on an individual basis and not as part of any class, consolidated, or representative action.

15. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Service and updating the "Last updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Nobler Works LLC regarding the Service.

16.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

16.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision.

16.4 Assignment

You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
